Position Summary...

The Senior Director Tax Planning is responsible for the overall tax planning initiatives both domestically and internationally optimizing the corporate and indirect tax profile. This position requires significant depth and breadth of international tax planning experience and technical capabilities due to the tax complexity and changing tax environment. This function is the liaison with the US planning, transfer pricing and controversy COEs and manages all Canadian tax planning, business initiatives, incentives, and the development of technical positions to ensure risks minimized, appropriate tax structures established, maximization of incentives and tax positions supported, managed, and defended as required.

This position will work closely with the US tax COE groups to ensure appropriate Canadian strategies are aligned with the Global tax strategies and the teams are collaborating to achieve the overall tax initiatives. The Senior Director position provides technical determinations relating to the tax planning and cross border initiatives, drawing on technical capabilities and experience with a breadth of scope to identify and mitigate tax risk. This position provides direct support to the VP Tax in the strategic identification and resolution of tax planning initiatives to ensure the appropriate tax is optimized with appropriate technical positions. This position is also expected to work closely with the VP of tax supporting the overall tax team and provide review functions and professional growth and development capabilities for the tax mandate.

What you'll do...

1. Support the VP Tax to motivate and develop a strong tax group through performance management coaching and career development.  Continuously assess and monitor talent development by identifying succession plans and challenging learning opportunities to foster professional growth to support the business.  Ensure highly engaged associates that provide a high level of performance and customer service by building a team-based tax environment, providing guidance where necessary. Play a leadership role in the greater Tax team ensuring cross-functional knowledge, training, and learning opportunities are developed throughout the team.
2. Initiate and lead all Canadian tax planning activities, including both domestic and international tax initiatives to ensure the Canadian tax position is optimized and tax risks minimized, collaborated, and aligned with the US and Canadian business partners driving value for the Canadian and Global organization.
3. Collaborate with key stakeholders to drive value and business partnerships for 1) tax planning; 2) tax controversy / resolution plans and 3) cross border technical tax consultations. Manage and build the relationship to ensure an ongoing productive and positive relationship between the teams.  Play a leadership role in managing our relationship and in-country strategy and tax positions with the various US Tax COE’s and ensure tax planning initiatives are consistent with the Canadian and Global tax strategies. 
4. All tax planning initiatives must consider all potential audit impacts and the strategic audit position developed prior to implementation.  Upon audit of the planning initiatives, provide the strategic oversight and guidance ensuring tax risk is minimized.  In addition, provide an advisory review and assessment of Audit requests with significant financial impact, validating Walmart’s tax position prior to delivering data to the Government Authorities.  Communicate to the VP of Tax any areas that need a strategic position.  Work with US controversy and legal when necessary to ensure a defense strategy is appropriately developed and a tax filing position confirmed and maintained.
5. Lead the transfer pricing function in Canada, ensuring all cross-border transactions have the appropriate contemporaneous documentation requirements for penalty protection.  Ensure the Global transactions policies are appropriate and documented for the Canadian standards.  Lead the Canadian APA process, ensuring appropriate tax positioning and OPM forecasting in the Canadian marketplace.  Work collaboratively with our US colleagues to ensure both the US and Canadian requirements are established and met.
6. Review all compliance files to ensure accurate and timely compliance, technical issues identified and accounted for appropriately and tax optimized.  Ensure tax files have the appropriate tax support necessary upon subsequent audit.  Ensure all tax positions are documented and technical positions development to support the tax compliance filing.
7. Provide guidance and direction to Treasury related to the financing structures and cash movements, optimizing our ETR and achieve efficient movement of cash.
8. Monitor legislative tax developments and assess the impacts to Walmart related to all International / OECD and domestic legislation. Draft recommendations, risks, and practical solutions, engage with outside tax and legal consultants as required.   Develop a communication and execution plan to ensure tax structures, cross border transactions and debt structure impacts are addressed, and risks assessed both in Canada and the US.  Identify areas necessary where advocacy measures should be taken.

Qualifications: (please add/edit)

  • An undergraduate degree combined with a professional designation (a professional accounting designation (CPA) and/or a legal designation (LLB/JD)) and the completion of tax specialist courses – In-depth tax courses or Masters of taxation.
  • Minimum of 15 years of tax experience, highly reputed as an expert in the industry, and with a demonstrated track record of success managing the tax function in a company and/or related experience within a national public accounting firm or law firm. Experience with navigating tax audits, disputes and litigation would be required.
  • Significant experience in Canadian and International corporate tax, including transfer pricing is required.  Knowledge of Indirect tax advantageous.
  • Strong understanding of cross-border tax issues, transfer pricing, US tax concepts and experience with APA applications
  • Experience with tax planning, tax risk management, business and transactional support, and accounting for income taxes under US GAAP
